Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the Nūr Evoke application and related services (the "Service") provided by Nūr Evoke (designed by Nur Behavioral Health). By using the Service you agree to these Terms.

1. The Service

Nūr Evoke is software for managing an ABA / behavioral-health practice, including records, scheduling, clinical data collection, session notes, documents, authorizations, and billing support.

2. Accounts & eligibility

Access is for authorized workforce members of a subscribing organization. You are responsible for maintaining the confidentiality of your credentials, enabling multi-factor authentication, and all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

  • Use the Service only for lawful purposes and in compliance with HIPAA and applicable regulations.
  • Do not attempt to access data outside your organization, probe or breach security, or disrupt the Service.
  • Do not upload malware or use the Service to violate the rights of others.

4. Customer data & PHI

Your organization owns the data it enters. For PHI, our handling is governed by a signed Business Associate Agreement (BAA), which controls in the event of any conflict with these Terms regarding PHI.

5. Third-party services

The Service integrates with third parties (e.g., AWS, Google Workspace, Availity, Gusto). Your use of those services is subject to their terms; we are not responsible for third-party services.

6. Intellectual property

The Service, including its software and design, is owned by Nūr Evoke (designed by Nur Behavioral Health) and its licensors. These Terms grant a limited, non-exclusive, non-transferable right to use the Service during your subscription.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. Nūr Evoke is a documentation and workflow tool and does not provide medical, clinical, legal, or billing advice; clinical and compliance decisions remain the responsibility of your organization and its professionals.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited as set out in your subscription agreement.

9. Indemnification

You agree to indemnify us against claims arising from your misuse of the Service or violation of these Terms or applicable law.

10. Termination

Either party may terminate as provided in the subscription agreement. On termination your right to use the Service ends; data handling follows the agreement and the BAA.

11. Governing law & changes

These Terms are governed by the laws of Florida. We may update these Terms; continued use after changes constitutes acceptance. Contact: info@nurbhealth.com.
